This website is operated by Esther Lim, the creator of ‘How to Report a Hate Crime’ booklets.  Throughout the site, the terms “we”, “us” and “our” refer to ‘How to Report a Hate Crime’ booklets. Esther Lim offers this website, including all information, tools and services available from this site to you, the user, and accessing this website’s content means that you consent to the terms listed below.

By visiting this site and/or downloading the e-booklets, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced here. These Terms of Service apply to all visitors of the site. 

Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service.

We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.

ONLINE BOOKLET TERMS

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.

Making the E-booklets available on the Internet or in other networks, reselling the E-book, and/or any use for commercial purposes is not permitted.  

Printing units more than 100 copies of the booklets will require consent by contacting info@hatecrimebook.com

These e-booklets’ content is protected by copyright laws so you cannot rearrange or edit the booklet in any way and put out for distribution.

Making copies or printouts and storing a backup copy of the E-booklet on another device is permitted for private, personal use only. This must not give rise to third-party access.

Inclusion of the E-booklet, in whole or in part, in a user’s own print or online publication is not permitted unless otherwise given permission by Esther.

Copying of E-booklet contents is only permitted for private purposes and only in the form of excerpts with proper credits.

If you are printing and distributing independently to your community, you must print out the entire booklet from front to back page and cannot edit out or add any content that is not of it’s original form. For any printing of 100+, it must be approved by Esther and the location of where it is being distributed must be shared.

If shared with the media, the creator’s name (Esther Lim) and/or www.hatecrimebook.com' must be mentioned or we will follow suit. 

The publisher reserves the right to alter, expand, limit, or discontinue the environment in which E-booklets are made available and to remove data at any time and without further notice. The publisher accepts no liability for data losses.

You may not use our booklets for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).

You must not transmit any worms or viruses or any code of a destructive nature.

A breach or violation of any of the Terms will result in an immediate termination of your Services.

GENERAL CONDITIONS

We reserve the right to refuse service to anyone for any reason at any time.

You agree not to duplicate in any other name, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any content on the website through which the service is provided, without express written permission by us.

The contents in the ‘411’ and ‘Resource’ section are subject to change due to changing laws and resources. Hate Crime Book will do it’s best to keep it up to date, but do not hold responsibility of not up-to-date information.

PROHIBITED USES

In addition to other prohibitions as set forth in the Terms of Service, you are prohibited from using the site or its content: (a) for any unlawful purpose; (b) to solicit others to perform or participate in any unlawful acts; (c) to violate any international, federal, provincial or state regulations, rules, laws, or local ordinances; (d) to infringe upon or violate our intellectual property rights or the intellectual property rights of others; (e) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability; (f) to submit false or misleading information; (g) to upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Service or of any related website, other websites, or the Internet; (h) to collect or track the personal information of others; (i) to spam, phish, pharm, pretext, spider, crawl, or scrape; (j) for any obscene or immoral purpose; or (k) to interfere with or circumvent the security features of the Service or any related website, other websites, or the Internet. We reserve the right to terminate your use of the Service or any related website for violating any of the prohibited uses.

INDEMNIFICATION

You agree to indemnify, defend and hold harmless ‘How to Report a Hate crime’ affiliates from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

SEVERABILITY

If any situation that arises that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

TERMINATION

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.

These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.
If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

ENTIRE AGREEMENT

The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.
