Terms of Service Agreement

This Terms of Service Agreement ("Agreement") is entered into between Through Peace (referred to herein as "we", "us", or “Through Peace") and the users ("you" or "user") of Easy Report mobile application (referred to herein as the "App").

By accessing or using the App, you agree to be bound by this Agreement. If you do not agree to the terms and conditions of this Agreement, please do not access or use the App.

INTRODUCTION

Through Peace created this App to aid persons in reporting hate crimes after the crime has occurred. This App is not a reporting tool and does not provide any information directly to the police. This App is not affiliated with any police department or government organizations. This App is solely designed to provide educational information to aid you in the reporting process.

USER REQUIREMENTS

1.1.        Users must be located within the State of California. Through Peace makes no representations that materials in the App are appropriate or available for use in other locations. If you access the App from other locations, you do so at your own risk and are solely responsible for compliance with any and all applicable laws, rules and regulations.

1.2.        Users must be sixteen years old or older.

USER RESPONSIBILITIES

2.1       Users are responsible for providing accurate and truthful information when using the reporting features of the App.

2.2      Users must use the App in compliance with all applicable laws and regulations.

Disclaimer of Warranty; Limitation of Liability

3.1       You expressly agree that use of the App is at your sole risk. Neither Through Peace nor any of its respective employees, directors, officers, agents, third party content providers or licensors (the “Through Peace Parties”) warrant that the App will be uninterrupted or error free; nor do they make any warranty as to the results that may be obtained from use of the App, or as to the accuracy, reliability or content of any information or service provided through the App.

3.2      All information contained on the App is intended for educational and informational purposes only. You should not rely on this information as a substitute for, nor does it replace professional advice.

3.3      The Through Peace Parties are not responsible for any actions or inaction on a user’s part based on the information that is presented in the App.

3.4      The Through Peace Parties are not liable for any communication, action, or inaction of law enforcement agencies, victims, or witnesses who utilize the reporting features of the App. Any communication or interaction between users and law enforcement agencies is the sole responsibility of the parties involved.

3.5      The Through Peace Parties cannot provide direct assistance or intervention in reported incidents.

3.6      To the extent permitted by law, the Through Peace Parties disclaim all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. The Through Peace Parties shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the App.

Indemnification

4.1       You agree to indemnify, defend, and hold the Through Peace, its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your use of the App or any violation of this Agreement.

Privacy Policy

5.1       We collect and process personal information in accordance with our Privacy Policy, which is incorporated into this Agreement by reference. By using the App, you consent to the collection and use of your personal information as outlined in the Privacy Policy.

Modification of Terms

6.1       We reserve the right to modify, amend, or update this Agreement at any time without prior notice. Your continued use of the App after any such changes constitutes your acceptance of the modified Agreement.

Governing Law

7.1       This Agreement shall be governed by, construed and enforced in accordance with the laws of the State of California as applied to agreements made and to be performed entirely therein. Any action brought to enforce the Agreement or in connection with this Site shall be brought in either the state or federal courts in Los Angeles County, California.
